Submission to The Senate Legal and Constitutional Affairs Legislation Committee inquiry into the Family Law Amendment Bill 2023

The Senate Legal and Constitutional Affairs Legislation Committee is currently reviewing a new Bill to amend the Family Law Act 1975. The Family Law Amendment Bill 2023 aims to ensure that the best interests of children are central to the family law system. It would remove the presumption of equal shared parental responsibility, and make other changes relating to parenting time, the definition of family, the amendment and enforcement of parenting orders, Independent Children's Lawyers, and standards for family report writers. This submission to the inquiry is from the Australian Institute of Family Studies. The submission reviews the aims and provisions of the Bill in light of the Institute's research work. Overall, the Institute supports the introduction of the Bill. The Institute's research indicates that the family law system requires greater emphasis on child safety and child participation, which is a key aim of the new Bill.
